BYGOLDEN RESERVE - TERMS & CONDITIONS

1. Introduction

1.1 These Terms and Conditions govern participation in the BYGOLDEN & Reserve Credits Program, operated by BYGOLDEN.
1.2 By joining or using the Program, clients agree to be bound by these Terms and Conditions.
1.3 BYGOLDEN may update, amend, or terminate the Program at any time without prior notice.

2. Eligibility

2.1 The Program is open to individuals aged 18 years or older.
2.2 Participation is limited to personal use only and cannot be transferred, shared, or used for commercial purposes.

3. Earning credits

3.1 Credits may be earned through eligible purchases, promotional campaigns, referral activities, or other methods determined by BYGOLDEN.
3.2 Eligible purchases must be made directly through BYGOLDEN. Online, discounted, or third-party purchases may not qualify unless explicitly stated.
3.3 Credits will be calculated based on the value of the transaction after discounts, promotions, or redeemed credits are applied.
3.4 Credits have no monetary value, are not legal tender, and cannot be exchanged for cash or credit balances.
3.5 Credits will appear in the client’s account only after payment is completed.

4. Redeeming credits

4.1 Credits may be redeemed for eligible treatments or products as determined by BYGOLDEN and may be subject to minimum balance requirements.
4.2 Credits cannot be used to purchase gift vouchers, medical-grade scheduled medications, or any items restricted by law or clinic policy.
4.3 The method and value of redemption will be set by BYGOLDEN and may change at any time.
4.4 Credits used for a booking that is cancelled or rescheduled in breach of BYGOLDEN’s cancellation policy may not be refunded.

5. Expiry and forfeiture

5.1 Credits expire 300 days from the date they are earned, unless otherwise stated.
5.2 Unused credits will automatically expire and cannot be reinstated.
5.3 Credits will be forfeited if:
– the client breaches any BYGOLDEN policy
– the client’s account is inactive for 300 days
– the Program is suspended or terminated

6. Transfers and limitations

6.1 Credits are non-transferable and may only be used by the account holder.
6.2 Credits cannot be sold, gifted, exchanged, or assigned.
6.3 Any attempt to misuse or manipulate the Program may result in immediate removal and forfeiture of credits.

7. Refunds and adjustments

7.1 If a transaction that earned credits is refunded, reversed, or disputed, the associated credits will be deducted from the client’s balance.
7.2 If a client has already redeemed credits that relate to a refunded purchase, BYGOLDEN may adjust the balance into a negative position or require repayment of the redeemed value.

8. Program changes, suspension, or termination

8.1 BYGOLDEN reserves the right to change, suspend, or terminate the Program or any of its features at any time, with or without notice.
8.2 This includes adjustments to earning rates, redemption values, eligibility criteria, credit expiry timeframes, or the discontinuation of benefits.
8.3 In the event of termination, all unused credits will expire immediately unless otherwise stated by BYGOLDEN.

9. Privacy and data

9.1 Personal information collected through the Program will be managed in accordance with BYGOLDEN’s Privacy Policy.
9.2 Clients consent to BYGOLDEN using Program data for the purposes of administering the Program, improving services, and communicating offers.

10. Limitation of liability

10.1 BYGOLDEN is not responsible for any loss, delay, or error relating to credit issuance, account access, or system updates.
10.2 BYGOLDEN is not liable for any loss or damage arising from the use or inability to use credits.
10.3 Nothing in these Terms and Conditions limits any rights that cannot be excluded under Australian Consumer Law.
